The buyer purchases the intended equipment “AS IS” and in no event shall the seller have any liability for nor shall the seller have any consequential damages, any losses of use or profits, or any other commercial or environmental losses. When operated in California, any off-road diesel vehicle may be subject to the California Air Resources Board in-Use Off-Road Vehicle regulation. It therefore could be subject to retrofit or accelerated turnover requirements to reduce emissions of air pollutants. It is the buyer’s responsibility to be aware of this law and comply with the regulation.
